This privacy policy is intended to inform users of the website www.kerius-finance.com (hereinafter the “Site”) about how KERIUS FINANCE collects, uses and protects their personal data, in accordance with Regulation (EU) 2016/679 of 27 April 2016 (hereinafter the “GDPR”) and French Act No. 78-17 of 6 January 1978, as amended, on information technology, data files and civil liberties (hereinafter the “French Data Protection Act”).

KERIUS FINANCE undertakes to ensure that the processing of personal data carried out on the Site complies with the GDPR and the French Data Protection Act.

1. Data Controller

The controller responsible for the data collected via the Site is: KERIUS FINANCE SUISSE SARL, Chemin de Blandonnet 2, 1214 Vernier / Geneva, registered with the Geneva Trade Register under IDE number CHE-460.735.969. 2. Data Collected and Purposes

The Site collects personal data as part of the following processing activities:

2.1 Contact form

When a user fills in the contact form available on the Site, the following data is collected: first name, last name, company, phone number, email address and message content. This data is used solely to respond to the request made by the user. Only the categories of data marked with an asterisk are mandatory.

2.2. Newsletter subscription

When a user subscribes to the newsletter, the following data is collected: first name, last name, company, phone number and email address. This data is used solely to send the newsletter and KERIUS FINANCE news updates.

2.3. Cookies and browsing data

When a user browses the Site, the following cookies may be placed:

• a cookie for managing cookie preferences (CookieConsent), placed by the Site itself;
• technical cookies related to the Google reCAPTCHA tool, used to protect the Site's forms against bots and fraudulent submissions;
• numerous cookies placed by YouTube (google.com/youtube.com) when videos embedded on the Site are loaded, for audience measurement and advertising personalization purposes on behalf of Google.

Details of these cookies, their provider and their category (necessary or marketing) are set out in the table in Article 7 below.

3. Legal Bases for Processing

• Contact form: performance of pre-contractual measures taken at the user's request and/or KERIUS FINANCE's legitimate interest in responding to requests addressed to it.
• Newsletter: user consent, obtained upon subscription.
• Non-strictly necessary audience measurement cookies: user consent, obtained via the cookie banner displayed on the user's first visit to the Site.

4. Data Recipients

The data collected is intended for members of the KERIUS FINANCE team authorized to access it by virtue of their duties. It may also be disclosed, strictly within the limits of their respective duties, to the following third parties:

• Infomaniak Network SA (Geneva, Switzerland), as host of the Site;
• KERIUS FINANCE SAS, a company registered with the Paris Trade and Companies Register under number 520 300 948, with its registered office at 17 rue Dupin, 75006 Paris, acting in France as a Financial Investment Advisor (ORIAS No. 13000716, member of ANACOFI-CIF), an affiliate of KERIUS FINANCE SUISSE Sàrl
• Google LLC / Google Ireland Limited, in connection with cookies placed by Google reCAPTCHA (form security) and by YouTube (videos embedded on the Site).

The data is neither sold, transferred nor rented to third parties for commercial purposes.

5. Retention Period

• Data from the contact form: kept for as long as necessary to process the request, then archived for a maximum of 3 years from the last contact for commercial prospecting purposes, unless the user objects.
• Data from newsletter subscription: kept until the user unsubscribes, or for a maximum period of 3 years from the last active contact.
• Browsing data and cookies: kept for a maximum period of 13 months.

6. Data Transfers Outside the European Union

The data is hosted in Switzerland (Infomaniak Network SA). As Switzerland is recognized by the European Commission as ensuring an adequate level of protection for personal data (adequacy decision of 15 January 2024), transfers of data from the European Union to Switzerland do not require any additional safeguards.

The data may also be transferred to France, to KERIUS FINANCE SAS, as part of the allocation of duties within the KERIUS FINANCE group. The group applies the GDPR to all of its clients, a large proportion of whom are located in France and the European Union.

Cookies placed by Google reCAPTCHA and YouTube also involve a transfer of certain data to the United States. This transfer is governed by the appropriate safeguards provided by Google under the EU-US Data Privacy Framework and/or standard contractual clauses adopted by the European Commission.

7. Cookies

A cookie is a file placed on the user's device while browsing the Site. There are two categories of cookies:

• cookies strictly necessary for the operation of the Site (for example, a preference management cookie or a security cookie), which are exempt from prior consent in accordance with CNIL recommendations, but of which the user is informed for transparency purposes;
• cookies that are not strictly necessary (audience measurement, social networks, embedded videos, advertising, etc.), which require the user's prior consent before being placed.

In accordance with the GDPR, every person has the following rights over their personal data: the right of access, rectification, erasure, restriction of processing, objection, and data portability. Users may also withdraw their consent at any time where processing is based on consent, without affecting the lawfulness of processing carried out before such withdrawal.

Users also have the right to lodge a complaint with the French data protection authority, the Commission Nationale de l'Informatique et des Libertés (CNIL): www.cnil.fr.

KERIUS FINANCE implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, and to guarantee the confidentiality and integrity of the data collected.
